Right to Manage

Clear, practical guidance for leaseholders considering or pursuing the right to take control of their building’s management.

If you are a leaseholder who is unhappy with how your building is being managed, you may have the right to take over its management through a process known as Right to Manage. It does not require you to prove any fault on the part of your current managing agent; it is a statutory right available to qualifying leaseholders.

The Right to Manage process can feel complex and uncertain. LT Property Services acts as a calm, experienced guide, helping you understand whether RTM is right for your building, supporting you through the process, and managing the building well once the transition is complete.

Understanding Right to Manage

What is Right to Manage?

Right to Manage (RTM) is a legal process that allows qualifying leaseholders to take over the management of their building by forming an RTM company. Once established, the RTM company takes on the management functions previously carried out by the freeholder or their managing agent.

The right is granted by the Commonhold and Leasehold Reform Act 2002. You do not need to prove your current agent has done anything wrong; you simply need to qualify and follow the statutory process correctly.

Do you qualify?

RTM is generally available to leaseholders of flats where:

  • At least two-thirds of the flats are held on long leases (over 21 years)
  • At least half of the qualifying leaseholders wish to participate
  • No more than 25% of the building is in non-residential use

There are some exceptions and the qualifying criteria can involve nuance. We can help you assess whether RTM is available for your building before you commit to anything.

Residential · Marylebone

High-end residential block, Central London

The situation

A high-specification residential block in Marylebone comprising 24 apartments across six storeys, managed for a private freeholder. The building had previously been managed by a larger national agent.

The challenge

Leaseholders were frustrated by slow response times, opaque service charge accounting and a series of maintenance issues left unresolved for months. The freeholder was concerned about reputational risk and wished to change agent.

What we did

We carried out a pre-management assessment to identify all outstanding issues, then managed a smooth transition from the existing agent ensuring all funds, contracts and compliance records were correctly transferred. We addressed the maintenance backlog within the first 90 days and implemented a new reporting framework.

The result

Leaseholder satisfaction improved significantly. Service charge accounts were prepared on time and clearly explained. The building now receives the level of attention its quality and value demands.

Residential · Right to Manage

RTM transition for a Victorian mansion block

The situation

A Victorian mansion block in Central London comprising 18 flats, where leaseholders had successfully completed a Right to Manage process and needed a new managing agent to take over.

The challenge

The previous management had been poor. Service charge records were incomplete, compliance documentation was out of date, and a number of significant maintenance issues had been ignored. Leaseholders were anxious about whether the situation could be turned around quickly.

What we did

We worked closely with the RTM company directors and their solicitors to manage the handover. We conducted a thorough compliance audit, arranged updated fire risk assessments and statutory inspections, and prepared a clear action plan communicated openly to all leaseholders.

The result

Within four months all critical compliance issues had been resolved and a planned maintenance programme was in place. RTM directors were confident in the management arrangements and leaseholders felt informed and properly represented.

Mixed-use building in the West End

The situation

A mixed-use building in the West End comprising ground-floor retail and restaurant units with residential apartments above, owned by a private investor.

The challenge

The previous managing agent had struggled with the competing needs of commercial tenants and residential leaseholders. Service charge apportionments were contested, communication had broken down and building maintenance had been neglected.

What we did

We introduced a clear management structure addressing the needs of both occupier types. We revised the service charge apportionment methodology, improved contractor management and established clear, consistent communication protocols with all parties.

The result

Service charge disputes reduced significantly. The building is now maintained to a consistently high standard and both commercial tenants and residential leaseholders receive clear, timely communication.

Major works programme for a period building

The situation

A late-Victorian residential building in Central London requiring significant external redecoration, roof repairs and structural works. The RMC board needed to manage the Section 20 process carefully and ensure value for money.

The challenge

The works required coordination between specialist contractors, structural engineers and the local planning authority. Leaseholders were concerned about costs and disruption, and needed clear communication throughout the programme.

What we did

We managed the full Section 20 consultation process, appointed a building surveyor, ran a competitive tender programme and supervised the appointed contractor. We provided regular written updates to all leaseholders and held progress meetings with the RMC board during the works.

Our office in Wigmore Street is open Monday to Friday, 9.30am to 5.00pm. Clients are always welcome to visit. We answer the phone. We return calls.

Our location

We are based at 16 Wigmore Street, London, W1U 2RF, close to Bond Street and Oxford Circus Underground stations, in the heart of Central London. Our proximity to the properties we manage means we can respond quickly and attend to buildings at short notice when required.

We manage properties across the UK, but our Central London base and deep knowledge of the area remains central to who we are. If you would like to visit our office to discuss your building, you are always welcome.

Professional accreditations and standards

The Property Institute

LT Property Services is an Associate Member of The Property Institute (TPI), the professional body for residential property management. Associate Membership requires adherence to professional standards and a commitment to continuing development.

The Property Ombudsman

We are registered with The Property Ombudsman, providing an independent dispute resolution service for clients who are unhappy with our service. This gives our clients an additional avenue for redress.

Client Money Protection

All client money held by LT Property Services is fully protected under a Client Money Protection scheme. This protection applies to all service charge funds and other client monies we hold.

Professional Indemnity Insurance

We carry full professional indemnity insurance, protecting our clients in the event of any professional error or omission in the services we provide.

No commission on services

LT Property Services does not earn commission, referral fees or any other remuneration from contractors, trades people or service providers engaged for works at properties we manage.

No commission on insurance

We do not earn commission or any other benefit from insurance providers or brokers. Our insurance recommendations are based entirely on the best interests of our clients.
